Kit and Membership Order Terms
Contents
The short version

- You can cancel a membership in the App or by email. Cancelling is at least as easy as signing up.
- Payments go through Stripe. We charge only the amounts shown to you before you order.

- The Terms of Service for Homeowners, including the agreement to arbitrate, apply to your order.

Important notice
YOUR ORDER IS COVERED BY THE TERMS OF SERVICE FOR HOMEOWNERS AT https://strech.ai/terms/. SECTION 19 OF THOSE TERMS REQUIRES YOU AND STRECH TO RESOLVE MOST DISPUTES THROUGH FINAL AND BINDING INDIVIDUAL ARBITRATION INSTEAD OF IN COURT, AND WAIVES YOUR RIGHT TO A JURY TRIAL AND TO TAKE PART IN A CLASS ACTION. YOU MAY OPT OUT OF ARBITRATION AS SECTION 19.10 OF THOSE TERMS EXPLAINS. SECTIONS 15 AND 16 OF THOSE TERMS LIMIT STRECH'S RESPONSIBILITY, INCLUDING FOR THE KIT, ITS DEVICES AND ALERTS. NOTHING IN THESE ORDER TERMS LIMITS ANY RIGHT YOU HAVE UNDER A LAW THAT CANNOT BE WAIVED BY AGREEMENT.
1 About these Order Terms
1.1 What these Order Terms are
These Kit and Membership Order Terms (these "Order Terms") apply when you order a Strech kit or a Strech membership from Strech Inc. ("Strech", "we", "us" or "our"). They form part of the Terms of Service for Homeowners at https://strech.ai/terms/ (the "Homeowner Terms"). Words that begin with a capital letter, such as "Kit", "Device", "Device Maker", "Alert", "Membership", "Shutoff Valve", "Founding Period", "App", "Stripe" and "Homeowner", have the meanings given in the Homeowner Terms.
1.2 Your order details
When you order, we show you the details of your order at checkout, and we send them to you again in your order confirmation (your "Order Details"). These Order Terms and your Order Details together are the "Kit Order Terms" referred to in the Homeowner Terms.
1.3 Which terms control
If your Order Details and these Order Terms conflict, your Order Details control for your order. If the Kit Order Terms and the rest of the Homeowner Terms conflict about the price, length, renewal or cancellation of a Kit or a Membership, the Kit Order Terms control, as Section 4.3 of the Homeowner Terms says. Nothing in the Kit Order Terms limits any right the law gives you.
1.4 How you accept
You accept these Order Terms, and the Homeowner Terms, by ticking the boxes at checkout confirming that you agree to them. If you do not agree, do not place the order. We keep a record of the version of these Order Terms and of the Homeowner Terms you accepted, and the date and time you accepted them.
1.5 Changes
We may change these Order Terms, as Section 1.5 of the Homeowner Terms describes. A change never applies to an order you placed before it takes effect, except as this Section 1.5 allows for a Membership. We will not raise the price of your Membership, or change how it renews, without telling you first in the App or by email, and giving you the chance to cancel before you are charged the new price or the change applies to you.
2 What we show you before you order
2.1 Shown at checkout and in your order confirmation
Before you order, and again in your order confirmation, we show you clearly:
- the Devices in your Kit and the price of the Kit;
- whether you are choosing a Membership, what it includes and its price, and how often you will be charged;
- whether there is a free period, how long it lasts, when it ends, what happens if you cancel during it, and the first amount you will be charged and when;
- how long the Membership runs, and whether and how it renews;
- how to cancel, and when a cancellation takes effect;
- any charge for cancelling before the end of a minimum period, and how it is worked out;
- whether you keep the Kit or return it if you cancel or your Membership ends, and, if it is to be returned, how Strech collects it;
- whether your Kit is delivered or set up with you at your home by Strech staff;
- who owns the Devices, as Section 5.2 explains;
- how a Device that stops working because of a fault is replaced;
- any tax; and
- the total.
What we show you for each of these is part of your Order Details and applies to your order.
2.2 No other charges
We charge you for a Kit or a Membership only the amounts shown in your Order Details, and any changed Membership price you were told about under Section 1.5 and did not cancel before. We never charge a cancellation charge, a charge for an unreturned Kit or any other charge that was not shown to you before you ordered.
3 Memberships and automatic renewal
3.1 How a Membership runs
Your Membership starts, runs and, if your Order Details say so, renews as your Order Details describe. If it renews automatically, it continues on the terms shown until you cancel or Strech ends it under Section 4.6.
3.2 Your agreement to automatic renewal
If a Membership renews automatically, we show you the automatic renewal terms clearly at checkout, close to where you agree, before you order. We ask you to agree to them by ticking a box, and we do not charge you for a renewal you did not agree to.
3.3 Reminders
Where the law requires, we send you a reminder in the App or by email before your Membership renews, or before a free period ends and the first charge is made. The reminder tells you what you will be charged, when, and how to cancel.
3.4 Your order confirmation
After you order, we send you an order confirmation by email that includes your Order Details, the automatic renewal terms, and how to cancel, in a form you can keep.
4 Cancelling
4.1 How to cancel
You may cancel your Membership at any time in the App, or by email to info@strech.ai with the subject "Cancel my membership". Cancelling is at least as easy as signing up. If you signed up online, you can cancel online, without calling us. We confirm your cancellation in writing.
4.2 When a cancellation takes effect
Your Order Details say when a cancellation takes effect, and what happens to any part of a period you have already paid for. Section 7 explains refunds.
4.3 Early cancellation charges
If your Order Details include a charge for cancelling a Membership before the end of a minimum period, they show it, or how it is worked out, before you order. We charge it only as shown there.
4.4 The Kit after you cancel
Your Order Details say whether you keep the Kit or return it when you cancel or your Membership ends. If the Kit is to be returned, they say how Strech collects it, and whether any charge applies if it is not returned. We tell you again how the Kit is collected when you cancel.
4.5 What stops when a Membership ends
Your Order Details say which features continue without a Membership. If the App stops showing the status of your Devices or sending you Alerts when a Membership ends, it no longer tells you about anything your Devices detect, and Section 4.13 of the Homeowner Terms applies.
4.6 If Strech ends a Membership
Strech may end a Membership, for example if it stops offering the Kit service in your area, or under Section 13.2 of the Homeowner Terms. Unless we end it because you broke the Homeowner Terms, we tell you in advance, and we refund any amount you paid for the part of a period after the Membership ends.
5 Delivery, setup and the Devices
5.1 Delivery or setup at your home
Your Order Details say whether your Kit is delivered to you or set up with you at your home by Strech staff on a day you agree. Section 4.4 of the Homeowner Terms explains setup. Setup by Strech staff covers placing Devices and plugging in the hub only, as Section 2.2 of the Homeowner Terms explains. Any Shutoff Valve is fitted by a licensed plumber, as Section 4.9 of the Homeowner Terms explains. Strech starts storing readings from your Kit only after you agree on the setup screen, as the Privacy Policy for Homeowners explains.
5.2 Ownership of the Devices
Your Order Details say whether you own the Devices once you have paid for them, or whether Strech owns them and you have the use of them for as long as your Membership lasts. If Strech owns them, you agree to take reasonable care of them, to use them only at the home where they are set up, and not to sell, give away or modify them.
5.3 Risk of loss
The Kit is your responsibility from when it is delivered to you or set up at your home. If Strech owns the Devices, you are not responsible for ordinary wear and tear or for a fault in a Device, and your Order Details say what applies if a Device is lost or damaged while it is in your care.
5.4 Devices with a fault
If a Device stops working because of a fault, tell us in the App or by email to info@strech.ai. We replace Devices with a fault as shown at checkout and in your Order Details. This does not limit any warranty the law gives you, which Section 15.3 of the Homeowner Terms keeps, or any right you have against the Device Maker.
5.5 Devices made by another company
The Devices are made by the Device Maker, not by Strech, as Section 4.2 of the Homeowner Terms explains. Section 4 of the Homeowner Terms explains what the Kit and its Alerts can and cannot do. A Kit or a Membership does not include alarm monitoring or emergency response. During and after the Founding Period, Strech does not promise to watch your Alerts or your home, to contact anyone, or to respond within any time, as Section 4.5 of the Homeowner Terms explains.
6 Payment
6.1 Stripe
Payments for a Kit and any Membership are processed by Stripe, as Section 6.1 of the Homeowner Terms describes. You authorize Strech to charge your card for the amounts in your Order Details, including each Membership charge you agreed to, until your Membership ends or you cancel.
6.2 Card holds for Visits do not apply
The rules in Sections 6.2 to 6.4 of the Homeowner Terms about card holds and charging at completion apply to Visits, not to Kits or Memberships.
6.3 Failed payments
If a charge fails, we may try again and ask you to update your card, as Section 6.5 of the Homeowner Terms describes. You remain responsible for amounts you owe.
6.4 Taxes
Any tax that applies to a Kit or a Membership is shown at checkout and in your Order Details.
7 Returns and refunds
Section 10 of the Homeowner Terms, at https://strech.ai/terms/#if-something-goes-wrong, explains refunds. The refunds in Section 10.5 of the Homeowner Terms for a duplicate or mistaken charge, or a charge you did not authorize, also apply to Kit and Membership charges. Any other return of a Kit, and any other refund for a Kit or a Membership, is as shown in your Order Details, together with any right the law gives you.
8 The Homeowner Terms apply
Your order is also covered by the rest of the Homeowner Terms, including:
- Section 4 of the Homeowner Terms, on the Kit and Alerts and what they can and cannot do;
- Sections 15 and 16 of the Homeowner Terms, on disclaimers and the limits on Strech's responsibility; and
- Section 19 of the Homeowner Terms, on resolving disputes, including the agreement to arbitrate, the class action waiver and your right to opt out.
The Privacy Policy for Homeowners at https://strech.ai/privacy/ explains how we handle information from your order and your Kit.
